The ongoing effort for individuals that were impacted by the alleged acts of Damian Merrick continues. There have been a number of delays, primarily because Meerick has claimed his attorney is having cancer treatments and not available for court.

After falling last week and hitting his head, the defense attorney has blood on his brain and was confined to the hospital for four nights. A meeting of the D.A. and defense attorney representative was held this morning with Judge Westfall. Merrick’s attorney has now been removed from the cases.
As such, Merrick will need to find a new attorney and a delay in trial will now be necessary to get the new attorney up to speed. The estimate is December as a new Trial
Recently Merrick had informed the court that he is now indigent: asking a court appoint a Public Defender.
However, the court has now ruled his Merrick’s request for court appointed attorney has been denied. He has a deadline of 9/16/16 to have a hired attorney to be in Court for an AS (Attorney Status) Hearing.

On July 20, 2016 Judge Westfall granted the defense motion for a continuance pertaining to the main Defense Counsel episode with cancer.
There will be a hearing before the Judge on August, 22, 2016 where the attorney will have to show that he is physically able to represent Merrick or he must hand over the case to an associate attorney.
If he is not fit to proceed he must remove himself from the case. Judge Westfall pointed out that the case was “getting old and is complicated, therefore cannot continue to be delayed”.
It was reported in LNO on August 26, 2016 that the Tarrant County DA’s office was prepared to move to trial on Merrick Trial is now planned for the week of September 12, 2016.

Damian Merrick, the head of a Grapevine Volleyball business, was indicted yesterday by the Tarrant County Grand Jury on 6 counts. Merrick was indicted on 3 counts of delivery of drugs to a minor and 3 counts of sexual assault of a minor. He is currently held in Tarrant County Jail on No Bond. In addition, there is a hold placed on Merrick by Hood County on 3 additional charges.
