However, predatory Chinese companies are selling illegal, non-registered medical devices on eBay in America and, in effect, destroying the market for many small businesses in America.

Chinese companies are openly violating US laws by selling unregistered, therefore illegal, medical devices in hundreds of pages found on eBay. “TBI and other American companies have spent a “King’s Ransom” with the FDA to register and legally sell equipment in the United States,” according to Nelson Thibodeaux, President of TBI. “Depending on the equipment, the cost could be from thousands of dollars to hundreds of thousands.”
“This flagrant and provocative move by China goes unfettered for all to see. This is not a complicated issue of China playing monetary games with their currency, these actions are not being done underground; anyone can go to eBay and witness literally thousands of examples of Chinese companies, selling unregistered medical devices; that, by law, are to be regulated by the FDA. Yet Congress continues to do nothing, while small businesses suffer and jobs are lost,” concluded Thibodeaux.
“Through our launch at http://igg.me/at/madeinamerica, a crowdfunding effort, we call upon patriotic Americans to join us in a renewed pride to manufacture in America, as well as, create a ground swell through the website, www.ChinaDefenseMilitia.com of donations and/or signatures to join us putting pressure on Congress to pass legislation to stop this insidious invasion of America,” Thibodeaux said.
The trade deficit with China today is a staggering $315 Billion.
TBI has requested the help of Congressman Kenny Marchant of the 24th District in Texas. Congress Marchant recently sent off letters to the FTC, FDA and US Customs. In part, Marchant wrote, “Enclosed with this correspondence to you are recent searches on eBay for ultrasound cavitation units, cryogenics units, radio frequency units, and professional lasers. It is my understanding that most of these attached items for purchase are being sold without the proper registration and thus should not be legally marketed in the United States.”
The FTC responded in part by stating; “Manufacturers (both domestic and foreign) and initial distributors (importers) of medical devices must register their establishments with the FDA unless a waiver has been granted.”
In other words, the Government acknowledges the law, yet the selling has now continued for three years. And during this time, TBI has experienced a decline in its equipment sales.
Donald Trump said, “When was the last time anybody saw us beating, let’s say China in a trade deal? They kill us. I beat China all the time.”
“There is a direct correlation between illegal activities of China and a decline of manufacturing jobs, as well as, loss revenue for small businesses in America. I think it is time we get like minds together and, if nothing else, fix this ONE atrocity in Congress and do it before it’s too late,” Thibodeaux concluded.
