Developer says 150 Primary and 150 Ancillary meant 300 residential units were approved by previous council and he is simply doing a reconfigure. City Attorney says current Ordinance is “silent” to question.

The Village zoning change seemed likely to draw no opposition at its first reading in January. However since that council meeting and upon closer scrutiny by a former mayor and council members, the project may have hit a snag over the “ancillary” definition. Also questions rose about the meaning of other references such as what a “Flat” or “Condo” may mean. During the workshop Councilman Tony Licata immediately brought up the question of the meaning of “ancillary units” with developer Richard Myers. Myers stated that the 600 sq. ft. in the current zoning would allow a 600 sq. ft. residential area to be sold as an apartment with an outside entrance or, as an alternative, the unit could be attached to a residential unit. |
